Game Licensing
We have two basic forms of licensing. We license the source code so that you can generate your own customized version of the game and we license the games on an "as-is" basis. The "as-is" license is less costly because it does not include the source code. Games licensed on an "as-is" basis can be rebranded for licensee's site(s). If you license the source code we deliver the Flash sources files in Macromedia Flash (.fla) format. We are available to do the customizations for you and/or consult with your team on how to customize the games. If you license the games on an "as-is" basis we provide you with the Flash output files in (.swf) format.

Game licenses for the source code range from $150 to $500 (August 2008 special -- takd an extra 25% off license fees for games $350 to $500 up to a maximum of 50% off with other applicable discounts) depending on the complexity of the game. Game licenses on an "as-is" basis are $200 per game. All licenses are "lifetime" and there are no additional license fees or royalties. We do offer discounts if you license multiple games of 10% for 2 games and 20% off for 3-5 games. 30% for 6-10 games. 40% for 11-20 games and 50% if you license all games. All of these discounts apply to source code or "as is" licenses. For the high score engine we offer $25 off the $500 license fee per game up to 10 games (that is the discount is for no more than $250). We also offer an additional 5% off for Flash Foundry and Toon Galaxy members.

We are available to provide customizations to the games. We can provide an estimate after consulting on the desired customizations. Please see the contact page for information on how to contact us for more information or for a quote on any game you'd like to have customized.

GAMES IN A FLASH SOURCE CODE LICENSE
Games in a Flash is solely owned by Eyeland Studio, Inc. Eyeland Studio, Inc. grants you a nonexclusive limited license to use the resources from Games in a Flash (the "products") in accordance with these Terms and Conditions (the "license") issued by our company.

a) ROYALTY FREE USAGE GRANTED
You may only use the products on any number of sites whether for any number of clients or for any number of sites produced by licensee with no further license obligation. Royalty Free Usage extends to the output of Flash files (.swf) created using Eyeland Studio's Games in a Flash resources. Licensee may not distribute Eyeland Studio Flash source files. Unless expressly authorized to do so in writing. Licensee may not give away for free the output of the Flash source file (.swf files) such that an individual or entity can use the game .swf file freely on their site without licensing the game or games. However, licensee may provide their individual client or clients with modified Flash source files when employed on a "work-for-hire" basis. For example, licensee may use Eyeland Studio's Games in a Flash resources to create a site or sites for personal use or for client use and if a client requests the source files, licensee may provide those files for their client. However, licensee may not mass distribute Eyeland Studio's Flash source files (see item c).

Licensee may not sell source code or output of source code in a manor directly competitive with www.gamesinaflash.com. This includes setting up a site to resell games and/or selling the games, whether in .fla or .swf format on public auction or marketplace sites such as ebay.com, sitepoint.com, or similar sites.

b) MODIFICATIONS
You are authorized to make any necessary modification(s) to our products to fit your purposes. Licensee may distribute or sell the output of such modifications in Flash (.swf) form.

c) UNAUTHORIZED USE
You may not place any of our products, specifically the Flash source files (.fla), modified or unmodified, on a diskette, CD, Website or any other medium and offer them for redistribution or resale of any kind without prior written consent from Eyeland Studio, Inc.

d) ASSIGNABILITY
You may not sub-license, assign, or transfer this license to anyone else without prior written consent from Eyeland Studio, Inc.

e) OWNERSHIP
You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of Eyeland Studio, Inc.
